Asking "How is this correctly translated?" (the only thing he is doing) would surely fall under the "fair use for academic purposes" clause. And if it doesn't, then when he is sued by Nintendo Japan, it will create a lot of press for Lojban. (I'm sure Slashdot, if nothing else, would pick up "First ROM translator sued! Ever!") Everyone except for Ted and people who are scrounging (rather hard, in this case) for something to bitch about is guaranteed to win.
